These terms govern your use of this website (the “Site”), operated by Stabilix LLC (“Stabilix”, “we”, “us”). By using the Site you agree to them. If you do not agree, please do not use the Site. Our Privacy Policy explains how we handle personal information and forms part of these terms.

1. Who the Site is for

The Site provides information about the AerFrame Patient Immobilization System (AFPIS) and related accessories for healthcare professionals, healthcare institutions and their advisers. It is not directed to patients or the general public, and nothing on it is medical advice.

2. Product information and regulatory status

• AerFrame is a medical device. In the United States it is cleared by the U.S. Food and Drug Administration under 510(k) for photon-based immobilization. Regulatory status, cleared or registered indications and product availability vary by country; the Site is not an offer to sell in any jurisdiction where the product is not authorized.
• Use of the device is governed by its labeling and Instructions for Use, which take precedence over anything on the Site. Product descriptions, specifications and performance figures are provided for information, describe the product as cleared at the time of publication, and may be updated without notice.
• Statements identified as “data on file” are supported by data held by Stabilix and available to qualified professionals on request. Compression and clinical figures depend on the patient, the treatment site and the institution’s protocols; results at your institution may differ.
• Demonstration images and films feature volunteers and models rather than patients.
• References to other systems are based on published specifications or on comparable rigid frame systems and do not imply endorsement by their manufacturers.

3. Intellectual property

The Site and its content — text, images, films, renderings, graphics and design — are owned by Stabilix or its licensors and are protected by copyright and other laws. STABILIX and AERFRAME are trademarks of Stabilix LLC; other names are the trademarks of their owners. You may view, download and print materials from the Site for your own professional evaluation of our products, provided you keep all notices intact. Any other use — including reproduction, redistribution, modification or commercial use — requires our written permission.

4. Materials sent on request

The brochure and other materials we send on request are provided for your professional evaluation. They are current at the date shown on them and may be superseded; contact us for the latest version before relying on them for a purchasing decision.

5. Requests and submissions

When you submit a request you confirm that the details are accurate and that you are contacting us in a professional capacity. Do not submit patient information or confidential information belonging to third parties.

6. Acceptable use

You agree not to interfere with the operation or security of the Site, to submit automated or fraudulent requests, to attempt to access non-public areas, or to use the Site for any unlawful purpose.

7. Disclaimer of warranties

The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, Stabilix disclaims all warranties, express or implied, about the Site and its content, including warranties of accuracy, completeness, fitness for a particular purpose and non-infringement. This section does not affect the warranties provided with any product you purchase, which are set out in the terms of sale.

8. Limitation of liability

To the fullest extent permitted by law, Stabilix and its members, officers, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, data or business, arising out of or relating to your use of the Site or its content, however caused. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the extent permitted by law. Nothing in these terms limits liability that cannot be limited by law.

Links to other websites are provided for convenience. We do not control them and are not responsible for their content or practices.

10. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction. This does not affect mandatory protections you may have under the law of your country of residence.

11. Changes

We may update these terms by posting a new version with a new effective date. Your continued use of the Site after that constitutes acceptance.
